Jehuda hat im Namen Schmuels gesagt:<\/strong><\/p>\n<p class=\"hetext\">\u05e0\u05db\u05e1\u05d9 \u05e2\u05d5\u05d1\u05d3 \u05db\u05d5\u05db\u05d1\u05d9\u05dd \u05d4\u05e8\u05d9 \u05d4\u05df \u05db\u05de\u05d3\u05d1\u05e8 \u05db\u05dc \u05d4\u05de\u05d7\u05d6\u05d9\u05e7 \u05d1\u05d4\u05df \u05d6\u05db\u05d4 \u05d1\u05d4\u05df\n<\/p>\n<p><strong>Die G\u00fcter <\/strong>, also die Grundst\u00fccke, <strong>der Nichtjuden sind der herrenlosen W\u00fcste gleich<\/strong> <sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"1\" data-mfn-post-scope=\"00000000000007540000000000000000_1776\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000007540000000000000000_1776-1\">1<\/a><\/sup><span id=\"mfn-content-00000000000007540000000000000000_1776-1\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"1\">Ein Grundst\u00fcck, das ein Jude einem Nichtjuden abgekauft hat und ihm den Kaufpreis bezahlt hat, aber den Kaufschein noch nicht erhalten hat, wird wie ein freigegebenes Gut angesehen<\/span>;<br \/>\n<strong>jeder, der sich ihrer bem\u00e4chtigt, hat sie erworben. <\/strong><br \/>\n<em>Der Talmud f\u00e4hrt nun fort und erkl\u00e4rt den Sachverhalt genauer:<\/em><\/p>\n<p class=\"hetext\">\u05de\u05d0\u05d9 \u05d8\u05e2\u05de\u05d0\n<\/p>\n<p><strong>Warum das?<\/strong><\/p>\n<p class=\"hetext\">\u05e2\u05d5\u05d1\u05d3 \u05db\u05d5\u05db\u05d1\u05d9\u05dd \u05de\u05db\u05d9 \u05de\u05d8\u05d5 \u05d6\u05d5\u05d6\u05d9 \u05dc\u05d9\u05d3\u05d9\u05d4 \u05d0\u05e1\u05ea\u05dc\u05e7 \u05dc\u05d9\u05d4 \u05d9\u05e9\u05e8\u05d0\u05dc \u05dc\u05d0 \u05e7\u05e0\u05d9 \u05e2\u05d3 \u05d3\u05de\u05d8\u05d9 \u05e9\u05d8\u05e8\u05d0 \u05dc\u05d9\u05d3\u05d9\u05d4\n<\/p>\n<p><strong>Sobald der Nichtjude das Geld erhalten hat, ist er von seinem Gut befreit<\/strong> und hat dementsprechend kein Eigentumsrecht mehr daran.<\/p>\n<p><strong>Der Israelit<\/strong> hier: der K\u00e4ufer <strong>aber erwirbt nicht eher<\/strong> <sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"2\" data-mfn-post-scope=\"00000000000007540000000000000000_1776\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000007540000000000000000_1776-2\">2<\/a><\/sup><span id=\"mfn-content-00000000000007540000000000000000_1776-2\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"2\">erlangt nicht eher das Recht am Eigentum<\/span> <strong>bis die Urkunde<\/strong>,<strong> also der Kaufvertrag, in seine Hand gelangt.<\/strong><\/p>\n<p class=\"hetext\">\u05d4\u05dc\u05db\u05da \u05d4\u05e8\u05d9 \u05d4\u05df \u05db\u05de\u05d3\u05d1\u05e8 \u05d5\u05db\u05dc \u05d4\u05de\u05d7\u05d6\u05d9\u05e7 \u05d1\u05d4\u05df \u05d6\u05db\u05d4 \u05d1\u05d4\u05df\n<\/p>\n<p><strong>Darum sind sie<\/strong>, die G\u00fcter, <strong>der W\u00fcste gleich und jeder, der sich ihrer bem\u00e4chtigt, hat sie erworben.<\/strong><\/p>\n<p class=\"hetext\">\u05d0&#8220;\u05dc \u05d0\u05d1\u05d9\u05d9 \u05dc\u05e8\u05d1 \u05d9\u05d5\u05e1\u05e3\n<\/p>\n<p><strong>Abaji sagte zu Rab Josef:<\/strong><\/p>\n<p class=\"hetext\">\u05de\u05d9 \u05d0\u05de\u05e8 \u05e9\u05de\u05d5\u05d0\u05dc \u05d4\u05db\u05d9\n<\/p>\n<p><strong>Hat denn Schmuel<\/strong> das <strong>so gesagt?<\/strong><\/p>\n<p class=\"hetext\">\u05d5\u05d4\u05d0\u05de\u05e8 \u05e9\u05de\u05d5\u05d0\u05dc\n<\/p>\n<p><strong>Schmuel hat doch<\/strong> auch <strong>gesagt:<\/strong><br \/>\n<\/p>\n<p class=\"hetext\">\u05d3\u05d9\u05e0\u05d0 \u05d3\u05de\u05dc\u05db\u05d5\u05ea\u05d0 \u05d3\u05d9\u05e0\u05d0\n<\/p>\n<p><strong>Das Staatsgesetz ist Gesetz,<\/strong><br \/>\n<\/p>\n<p class=\"hetext\">\u05d5\u05de\u05dc\u05db\u05d0 \u05d0\u05de\u05e8\n<\/p>\n<p><strong>der K\u00f6nig hat aber angeordnet: <\/strong><br \/>\n<\/p>\n<p class=\"hetext\">\u05dc\u05d0 \u05dc\u05d9\u05e7\u05e0\u05d9 \u05d0\u05e8\u05e2\u05d0 \u05d0\u05dc\u05d0 \u05d1\u05d0\u05d9\u05d2\u05e8\u05ea\u05d0\n<\/p>\n<p><strong>Felder k\u00f6nnen nur durch einen Kaufvertrag erworben werden.<\/strong><br \/>\n<\/p>\n<p class=\"hetext\">\u05d0\u05de\u05e8 \u05dc\u05d9\u05d4\n<\/p>\n<p><strong>Da sprach er zu ihm:<\/strong><br \/>\n<\/p>\n<p class=\"hetext\">\u05d0\u05e0\u05d0 \u05dc\u05d0 \u05d9\u05d3\u05e2\u05e0\u05d0 \u05e2\u05d5\u05d1\u05d3\u05d0 \u05d4\u05d5\u05d4 \u05d1\u05d3\u05d5\u05e8\u05d0 \u05d3\u05e8\u05e2\u05d5\u05ea\u05d0 \u05d1\u05d9\u05e9\u05e8\u05d0\u05dc \u05d3\u05d6\u05d1\u05df \u05d0\u05e8\u05e2\u05d0 \u05de\u05e2\u05d5\u05d1\u05d3 \u05db\u05d5\u05db\u05d1\u05d9&#8216; darauf kam ein anderer Israelit und grub ein wenig darin. <\/strong><br \/>\n<strong>Da kam der Rechtsfall vor R.
